出口欧盟轨道车辆应对环保法规管控的对策

Strategies for Railway Rolling Stocks Exported to the EU in Response to Environmental Regulatory Controls

    目的 目前欧洲联盟(以下简称“欧盟”)尚未出台专门针对轨道交通行业的环保法规指令。为解决轨道车辆这一复杂物品在出口欧盟时需要应对相关法规指令这一管控问题,有必要研究欧盟相关法规指令的适用条款,明确其管控要求,以制定应对策略。
    方法 基于国内轨道车辆制造企业的角度,梳理并阐述了适用的欧盟法规指令及其管控要求,主要包括欧盟制订的REACH法规(即《化学品注册、评估、授权与限制法规》)、POPs(持久性有机污染物)法规、ODS(消耗臭氧层物质)法规、F-Gas(氟化温室气体)法规、废弃物框架指令等。分析了国内轨道车辆制造企业在出口轨道车辆时须履行的义务及应对策略,制订了出口欧盟轨道车辆项目应对REACH法规的具体流程,并提出应对欧盟法规指令管控要求的对策及建议。
    结果及结论  欧盟某些环保法规指令涉及的义务较多且触发条件比较复杂,国内轨道车辆制造企业应建立相应流程,以识别相关义务并实施管控。在制定管控措施前,建议根据欧盟法规管控范围筛选出适用的管控物质,以确保在风险可控的范围内降低企业的管控成本。在管控形式上,建议国内轨道车辆制造企业采用“检测+声明+其他辅助文档”的复合管控手段实施管控。

     

    Abstract:
    Objective At present, the European Union (EU) has not issued environmental regulatory directives specifically targeting the rail transit industry. To address the regulatory control issues faced when exporting complex products such as railway rolling stocks to the EU, it is necessary to study the applicable provisions of relevant EU regulations and directives, clarify their control requirements, and formulate response strategies.
    Method From the perspective of domestic railway rolling stocks manufacturing enterprises, the applicable EU regulations and directives and their control requirements are reviewed and elaborated, mainly including the REACH Regulation (registration, evaluation, authorization and restriction of chemicals), POPs (persistent organic pollutants) Regulation, ODS (ozone-depleting substances) Regulation, F-Gas (fluorinated greenhouse gases) Regulation, and Waste Framework Directive. The obligations that domestic railway rolling stocks manufacturing enterprises must fulfill when exporting railway rolling stocks are analyzed, along with corresponding response strategies. A specific process for addressing the REACH Regulation in projects of exporting railway rolling stocks to the EU is developed, and countermeasures and recommendations for meeting EU regulatory control requirements are proposed.
    Result & Conclusion  Certain EU environmental regulations and directives involve numerous obligations and relatively complex triggering conditions. Domestic railway rolling stocks manufacturing enterprises should establish corresponding processes to identify the relevant obligations and implement control measures. Before formulating control regulatory measures, it is recommended to screen the applicable controlled substances based on the scope of EU regulatory requirements, so as to reduce enterprise compliance costs within a controllable risk range. In terms of control approach, it is recommended that domestic railway rolling stocks manufacturing enterprises adopt a composite control method of 'test + declaration + supplementary supporting documentation'.
